www.locummonkey.co.uk is a site operated by Quvent Limited, a company registered in Scotland (Company Number SC340824) and having its registered office at 6/1, 337 Glasgow Harbour Terraces, Glasgow, G11 6BH ("We").
ACCESSING OUR SITE
Access is permitted on a temporary basis and we reserve the right to withdraw and amend the service we provide on our site without notice (see below). We will not be liable if for any reason our site is unavailable for any time or for any period.
From time to time, we may restrict access to some parts of our site, or our entire site, to users who have registered with us.
If you chose or are provided a user name, password or any other piece of information as part of our security procedures you must treat such information as confidential and must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you fail to comply with the provisions of these terms of use. When using our site you must comply with the provisions of our acceptable use policy.

WHO MAY REGISTER TO USE OUR SITE
Only the following users are eligible to register and use our site:-
• Qualified General Practitioners
• General Practitioner Practices
• National Health Service Departments and Organisations.
Any users who do not fall into any of the three classes mentioned above cannot register with us and/or use our site.
Recruitment Agencies and Locum Agencies are expressly prohibited from using, registering with and accessing our site under any circumstances.
Any users who do not fall into the classes of users listed above will have their membership immediately terminated and access to the site prohibited. We will not be responsible for refunding any funds held or paid following termination of membership.
General Practitioner Practices can only use the website to contact Locum General Practitioners about specific and real jobs and are not permitted to use the site for any other purpose.
NHS Departments and Organisations can use the site to contact their staff for any legitimate purpose.
OUR SERVICE
Locum Monkey provides an advertising facility by SMS (short message service or text message). We shall use reasonable endeavours to see that the SMS messages are delivered, but due to the nature of this technology and factors beyond our control, we cannot and do not guarantee their delivery (Please see "Our Liability" section of this document). No refunds, replacements or cancellations can be provided as a result of failure of message delivery.
ADVERTISEMENTS ON OUR SITE
The advertisements appearing on our site are from third parties. We are not responsible for checking their accuracy. We are impartial to their content and they must not be interpreted as a recommendation from us. The adverts link to third party websites over which we have no control. Since our service is free to GP locums and GP surgeries, we rely on these advertisements to fund our service.
RECEIVING INFORMATION FROM US AND OUR PARTNERS
We may send you bulletins and newsletters relating to the healthcare sector. The bulletins may contain news about the healthcare sector, information and updates about Locum Monkey services and information and offers from our sponsors and partners. You may receive the bulletins and newsletters by email or post . We will be impartial to their content and you must not interpret this as a recommendation from Locum Monkey. We will ensure that the content is relevant to the healthcare sector. This activity is vital to funding our service and keeping it free for GP locums and GP surgeries. By registering with Locum Monkey and using our service, you agree to accept such correspondance from us.
Please note that Locum Monkey will NOT pass or sell your details to a third party including our partners. Locum Monkey will remain the sole user and keeper of your personal details.
TERMS OF PAYMENT
Locum Monkey is free to use for GP locums and GP surgeries. Other NHS organisations using our SMS communication facility will be sent an invoice on the 28th of every month by email detailing their activity and the outstanding amount due since their previous invoice. You can post a cheque to Locum Monkey, pay using internet or telephone banking, BACS transfer or other electronic means within 14 days of the invoice date. Late payments may be subject to a 10% surcharge of the total amount owed at the discretion of Locum Monkey.
Our Service Charges
Our current charges are listed below and are inclusive of VAT. All charges are in UK pounds sterling. No other currency is accepted by us at this moment. We reserve the right to alter our charges at any time without notice but will always display the charges on our website. You will always be informed of the total cost of your transaction prior to payment when using our website.

INTELLECTUAL PROPERTY RIGHTS
We are the owner and licensee of all intellectual property rights in our site and in the material published on it. These works are affected by copyright laws and treaties around the world. All such rights are reserved.
You may print off one copy and may download extracts of any page(s) from our site for your personal reference and you may draw the attention of others within your organisation to material posted on our site.
You must not modify the paper or digital copies of any materials you have printed off or downloaded in anyway and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying texts.
Our status (and that of any identified contributors) as the authors of material on our site must always be acknowledged.

RELIANCE ON INFORMATION POSTED
Our site provides a way of advertising vacancies for Locum General Practitioners and contacting staff by email and SMS message. The web site operates as a communication and advertising tool. We are a means of advertising your information only. No refunds, replacements or cancellations can be provided in the event that desired response is not achieved. No guarantees, warranties or indemnities are granted by us in respect of: filling vacancies; the response received; or any other matter out with our control and we shall not be liable for any response (or lack thereof) received in respect of the advertisement of your information.
Locum Monkey does not perform any checks to verify the information provided by users and posted by users on the website. Information provided by users is taken at face value. Users are responsible for and warrant that they are posting only true and accurate content on the site. Liability for any losses arising in respect of the posting of false information shall fall upon the poster.
Any party accepting the service of a Locum General Practitioner or Doctor advertising on Locum Monkey must take their own steps to verify the accuracy of the information, the qualifications held and suitability for the position in question. Locum Monkey does not check or verify General Practitioners' qualifications or suitability for any position. It is the responsibility of users to ensure they have or the person applying for the position has all necessary qualifications, licences, registrations and are suitable for the position applied for.
Locum Monkey is a communication and advertising tool only. Commentary and other materials posted on our site are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our site or by anyone who may be informed of its contents.
OUR SITE CHANGES REGULARLY
We aim to update our site regularly, and may change the content at any time. If the need arises we may suspend access to our site, or close it indefinitely. If any of the material on our site is out of date at any given time we are under no obligation to update such material.
OUR LIABLITY

Locum GP users of the site may pass certificates and references to prospective employers at their own discretion. Locum GPs should protect this uploaded material with a password and are responsible for the security of their own password. Locum Monkey will take reasonable steps to protect the data they hold. Locum Monkey can not be held in any circumstances liable for any loss or disclosure of data.
For staff contact details provided by NHS Departments and Organisations, Locum Monkey will use reasonable efforts to maintain the security of staff details and contact details provided. Locum Monkey will not pass such information to third parties. When such information is provided to Locum Monkey, it is a term and condition of use of the site that NHS Departments and Organisations have the consent of their employees to provide such data to us and have obtained the consent of staff to be contacted by SMS message and email.
We will not be responsible or liable to any third party for the content or accuracy of any materials posted by you or any other user of our site.
We have the right to remove any material or posting you make on our site if, in our opinion, such material does not comply with the content standards set out in our acceptable use policy.
COMMUNICATION METHODS
Locum Monkey communicates principally by email and SMS message. Delivery of such communications and time of delivery of such communications can not be guaranteed and is often dependant on factors out with our control and the nature of the technology used.

VIRUSES, HACKING AND OTHER OFFENCES
You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any other server, computer or database connected to our site. You must not attack our site via denial-of-service attack or a distributed denial-of service attack.
By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breaches to the relevant law enforcement authorities and we will co-operate with these authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.
